Auctions are a great way to get deals on a number of different things. There are so many categories to choose from that you can purchase anything from your next investment property to livestock to firearms.
However, while it’s easy to grab a deal when you head to your next firearms auction, auctioneers who sell guns at auction are required to adhere to the applicable laws in a strict manner. Therefore, this applies to potential buyers looking to purchase a firearm at auction.
Here is all you need to know about purchasing a firearm at auction:
Understanding The Law
While purchasing a firearm at your next auction is a great way to save on costs and find a bargain, it is pointless if you do not have the required licences to own a firearm, as all lots will be retained by the seller pending proof of these. If, for whatever reason, the buyer is not able to produce the necessary proof, the auctioneer or ammunition dealer has the choice to resell the lot. Therefore, it is imperative that all necessary licences are procured ahead of the auction.
As such, individuals attending their desired firearms auction must comply with South Africa’s current firearms regulatory framework, which is comprised of the Firearms Control Act of 2000 and its subsidiary legislation. South Africa has strict legislation governing the licensing, purchase and use of a firearm, with the comprehensive system also providing for matters connected to the Act, such as auctions.
According to the Firearms Control Act, here are the requirements that must be met in order to receive a firearm license or renew your license:
Receive Training:
The first step is to undergo firearm training at a government-accredited institution in order to receive your training proficiency certificate. This will provide proof that you have the necessary knowledge to handle a firearm. During the process, you will be taught how to handle a gun and which conditions allow you to use the weapon.
Apply for a Competency Certificate:
Once you have completed your training, you will need to apply for a competency certificate. In order to do so, you are required to complete the SAPS 517 application form. This must be submitted to the designated firearms officer (DFO) at your local police station. Here are the criteria needed to obtain this certificate:
- Be at least 21 years old. If not, you must supply convincing reasons why you are applying for a competency certificate or firearm licence.
- Be a South African citizen or have a permanent residence permit.
- Be mentally stable and fit.
- Be free from any form of addiction to any substance such as drugs or alcohol.
- Have no criminal record.
Complete the Firearm Application Form:
Once all of the above has been completed, you will need to complete the firearm application form - SAPS 271. This will need to be submitted with a certified copy of the proficiency certificate you received, a certified copy of your ID or passport, and two recent passport-size colour photographs (no older than three months).
Renewing your Firearms License:
According to the South African government, you must renew your firearm licence at least 90 days before the expiry date. Depending on the type of licence you were issued with, expiry varies between two and ten years. Remember, you will not be able to purchase a firearm or ammunition on auction without a firearm licence. Here are the documents SAPS recommends when renewing your firearm licence:
- The original firearm licence.
- The original training proficiency certificate.
- The competency certificate from when you first applied for the firearm licence.
- Four recent passport-size colour photographs.
- You will also be asked to fill in an application for a competency certificate (SAPS 517) and an application for renewal of licence form (SAPS 517(e)
Tips for buying firearms
While it’s easy to get swept up in the thrill of buying goods at auction, purchasing a firearm is a serious endeavour. Here are some tips to consider when participating in your next firearm auctions:
Do your research Research
is an integral part of purchasing firearms at auction. Only purchase from individuals you know, or make sure to research the seller’s previous sales to establish a sense of trust. There are countless reputable auction houses across Southern Africa. You can browse Auction Calendar to view upcoming listings from these sellers. Additionally, you need to research the specific type of firearm you are interested in. This includes getting to know its market value, features, and any potential issues.
Attend previews
Many auctions allow potential buyers to inspect items before the auction begins. However, most operate with the Voetstoots Clause, which means items are sold “as-is.” During this preview, it's an excellent opportunity to check for any defects and verify their condition before making a bid during the auction procedures.
Set your budget
This is where research plays a pivotal role as it allows you to determine how much you are willing to spend on your desired items. You’ll now have a good idea of the gun’s value and you’ll be able to establish how much you are willing to spend before the auction starts. Stick to your budget to avoid overspending in the heat of the moment.
Ask questions
Don’t be afraid to ask questions! Questions such as who the owner is, what it was used for, and why they are selling it, are good to ask. A firearm is a long-term investment, and you need to know exactly what you are buying. If you’d like to get this information ahead of time, Auction Calendar has a feature that allows you to contact auctioneers directly. This will allow you to get all the necessary information beforehand.
Transporting Firearms
Transporting your newly purchased firearm is a consideration that many potential buyers will need to think about before heading to auction. While South Africa generally allows firearm owners to transport firearms in their vehicles, there are strict regulations that must be followed to ensure compliance with the law. Here are a few key points to consider:
Transportation in a Locked Compartment: Firearms should be transported in a locked compartment of the vehicle, such as a lockable gun safe or a compartment specifically designed for the secure transportation of firearms.
Ammunition and Firearms Separation: Ammunition should be stored separately from the firearm during transportation.
Licence and Documentation: The person transporting the firearm should have a valid firearm licence and relevant documentation readily available for inspection by law enforcement if required.
Purpose of Transportation: The purpose of transporting the firearm should be lawful, such as hunting, sports shooting, or self-defence.
Navigating firearm auctions requires a balanced approach that combines thorough research, adherence to legal regulations, and a disciplined budget. Whether you’re a seasoned collector or a first-time buyer, understanding the intricacies of the auction process and carefully inspecting your desired firearm can be a great way to make the auction floor a comfortable and riveting place. As the gavel falls and ownership transitions, responsible firearm ownership remains a priority, making auctions not just a marketplace but a gateway to a world where history, legality, and personal responsibility converge.
